Approved by Agcom, the text regarding copyright protection. The scourge of illegality that has escalated on the Internet is numbered. Within 60 days, the text will become final and applicable to sites engaged in piracy.

In 60 days, just the time needed for a public consultation, the Agcom text will be enforced. This time the fight against copyright infringement via the Internet becomes law, initiating a crackdown on illegal sites. No gag, therefore, but recognizing the authorship of a work (music, film, streaming, etc.) is a protection that was needed before the phenomenon became so exponential.
According to the new text, when a copyright violation is detected, a removal request must be sent. The owner of the pirate site has 48 hours to remove the content that infringes copyright. After this period, if the removal has not occurred, the copyright holder can appeal to Agcom.
At this point, Agcom implements a dialogue between the parties. In the fourth point, it is Agcom that requests the removal of the material protected by copyright. If the site does not remove the content, a pecuniary administrative sanction ranging from ten thousand euros to two hundred thousand euros is triggered (paragraph 31 of law 249 of 1997).
Finally, and this is an important point, if the site is abroad, Agcom considers two solutions:
– preparation of a list of illegal sites to be made available to internet service providers;
– possibility, in extreme cases and after dialogue, of blocking the website’s domain name, or the IP address.
Between those hoping for a stricter rule and those appealing to freedom of expression, the new copyright text arrives. Satisfied is the President of Agcom, Corrado Calabrò, who explicitly underlines how this law, inspired by that of the United States, places no limitations on freedom of expression via the Internet but acknowledges the rightful authorship of those who hold copyright. Of the same opinion is the President of Fimi (Italian Music Industry Federation ) Enzo Mazza, who points the finger against counterfeiting, an ever-open wound that every day cancels musical works and denies creative authorship.
