Apple is at a particular stage in the lawsuit filed against Motorola for infringement of some patents. Probably the company from Cupertino is considering dismissing the proceeding since Motorola, now in the hands of Google which has acquired its patents, would no longer be the sole party involved.
Proceeding with the lawsuit would mean involving a new (probably very formidable?) corporate entity which, in plain facts, has little to do with it except for recent ownership reasons.
In short, why “bother” Google in a matter for which the direct parties – at a purely technical and material level, at the time of the contested events – are none other than Motorola e Apple? This is very briefly the position of the company from Cupertino which, in requesting the dismissal of two cases, points to a hypothetical lack of interest from Motorola in proceeding, no longer being the owner of the patents.
There is another point on which reflection is invited: as known, corporate acquisitions exceeding 66 million dollars in agreed value are subject to scrutiny by the Antitrust in America.
This means that the definitive ratification by the authorities regarding the ownership transfer of Motorola to Google has not yet been received: if all goes according to plan, this “verdict” should arrive in the early months of 2012.
Until then, in any case, the legal proceeding should be “frozen”, awaiting the outcome of the Antitrust decision.
Hence the request by Apple to dismiss or at least suspend the two cases.
One point is indisputable: the moment Google will be fully and completely the owner of Motorola and its patents, then the issue will reopen and it is not certain that the web search giant will decide to overlook it.
After all, the stakes are obvious to everyone, since more than just a judge’s ruling is on the line: in fact, a real open challenge is emerging between the world Apple and the Android.
