Apple requests dismissal of two Motorola lawsuits

Apple is at a peculiar stage in the proceedings of the lawsuit filed against Motorola for patent infringement. The company from Cupertinois likely considering dropping the case since Motorola, now in the hands of Google which acquired its patents, would no longer be the sole plaintiff.
Proceeding with the lawsuit would mean involving a new (and probably very formidable?) corporate entity that has little to do with the facts themselves, except for recent ownership matters.
In short, why “bother” Google in a matter for which the directly concerned parties – at a purely technical and material level, at the time of the disputed events – are none other than Motorola e Apple? This, very briefly, is the position of the company from Cupertino which, in requesting the dismissal of two lawsuits, points to Motorola’s hypothetical lack of interest in proceeding, as it is no longer the owner of the patents.
There is another point worth considering: as is known, corporate acquisitions exceeding $66 million in agreed value are subject to antitrust review in America.
This means that the definitive ratification by the authorities regarding the transfer of ownership of Motorola to Google has not yet been received: if everything goes as planned, this “ruling” should arrive in the early months of 2012.
Until then, in any case, the legal proceedings should be “frozen”, pending the outcome of the antitrust decision.
Hence Apple’s request to dismiss or at least suspend the two lawsuits.
One thing is certain: the moment Google is fully the owner ofMotorola and its patents, then the issue will reopen and it is not certain that the web search giant will decide to overlook it.
After all, the stakes are clear to everyone, since there is much more than a judge’s pronouncement on the line: in fact, a real open challenge is looming between the world of Apple and that of Android.
