Free Wi-Fi for Businesses: End to Data Monitoring and Merchant Obligations

Commercial establishments will be able to offer free Wi-Fi without having to request and store customer data: this is established by the Data Protection Authority.

Another step forward in sharing free Wi-Fi networks in Italy: the Data Protection Authority has revisited the topic of connectivity that commercial businesses might want to offer their customers.
This issue has been debated for years, as previous legislation required business owners to request and store data of those using the connection for potential future identification.
Today, it is learned that the Data Protection Authority has therefore accepted and confirmed an indication from the Italian Federation of Public Establishments (FIPE) which states that “public establishments can freely provide Wi-Fi access to users and potentially PCs and terminals of any type“, leaving it to the customer’s discretion to potentially share their data and, above all, relieving the establishment of responsibility regarding the web usage made by the customers themselves.

A decisive change in perspective that would significantly facilitate the role of the business owner, who is no longer obliged to have tools for data monitoring and archiving. The Authority also pointed out that the procedure required until now fell under cases “where personal data processing cannot be carried out without the consent of the data subject“.
Thus, the spread of free networks has taken a new path.
