Jailbreak iPhone is legal in the United States

Jailbreaking an iPhone has become legal in the United States, following the decision by the Copyright Office, the competent office within the Library of Congress. Thus, modifications to one’s iPhone are now permitted.

The practice of jailbreaking is still illegal in Italy, but in America the “spell” of the inviolability of Apple devices has been broken. The ruling that effectively makes the practice of “unlocking” the iPhone legal is therefore effective only in the United States: anyone can modify their device in America.
However, it’s not all smooth sailing, as Apple will continue to enforce the rule that jailbreaking an iPhone automatically voids the warranty. The Cupertino headquarters also insists that this new provision represents a copyright infringement, since – by modifying the iPhone – one would effectively be using a modified version of Apple’s proprietary operating system.
The issue regarding the legality of jailbreaking iPhones was raised by the Electronic Frontier Foundation, an organization founded to defend digital rights.
From today in America, unauthorized applications are greenlit, iPhone cracking is greenlit, experimentation with your own device is greenlit. Fingers crossed, however, that the iPhone will never need technical assistance.
In Italy, instead, we await the imminent release of the iPhone 4.
