The war between technology companies has long been waged in courtrooms around the world: with accusations of plagiarism and patent infringement , a new chapter has been written in the ongoing saga between Samsung and Apple.
Apple, the Cupertino-based company, has sued Samsung on charges of plagiarism ; specifically, the reference is to the similarity between the progenitor of tablets – Apple’s iPad – and the Samsung Galaxy Tab .
According to the prosecution, the latter was merely the result of copying, especially regarding its design.
However, a ruling from the British High Court, which was asked to rule on the matter by Apple, completely overturns the prevailing viewpoint.
According to Judge Colin Birss, it is not possible to speak of plagiarism simply because Samsung Galaxy Tabs are not as cool as the iPad.
To put it in Italian, Samsung’s tablets are not equally “cool“.

They are certainly devices that are similarly thin, but there are small differences – from the flat edges of the iPad to a simpler and more elegant overall line – that make the two types of tablets absolutely recognizable.
Beyond mere measurements of thickness and design, the judge went further, stating that “Samsung devices are very thin, but they do not have the sophistication and great simplicity of Apple devices. They are not equally cool, so the overall impression they convey is different“.
This is certainly a ruling destined to provide useful material for advertisers who could use these words to craft bespoke campaigns, both for Samsung and for Apple.
Naturally, Samsung ‘s management expressed satisfaction with the verdict; Apple spokespeople, on the other hand, were less pleased, reiterating how wrong it is to copy something and how, in their opinion, it is necessary to defend the company’s intellectual property.
